Waivo is hereby responsible for theft or direct damage to real or personal property of the vacation rental property as a result of Your acts or omissions. Waivo will pay the lesser of the cost of repairs or the cost to replace the property up to $2,500. This waiver does not negate your responsibilities as a renter for items outside of Waivo’s responsibilities. This is not an agreement to provide insurance. You are buying a waiver of the security deposit otherwise due as part of Your vacation rental property lease agreement. II. EXCLUSIONS This Security Deposit Waiver will not pay for damages or theft resulting from: 1. Acts of God 2. Prior damage, cosmetic damage, or normal wear and tear 3. Fine art, collectibles, or sets of items This Waiver will not pay for damage or theft of property owned by You. This Waiver will not pay for costs associated with odor, debris removal, backups of sewers and drains, landscaping, marring, maintenance, or mechanical breakdown. III. CONDITIONS Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the waiver, and shall exercise that authority in a reasonable manner. Waivo reserves the right to determine if damage is eligible for reimbursement at actual cash value. This Waiver will pay for excessive cleaning, as a direct result of damage, over and above the normal cleaning fee. An irreparable stain or spillage is considered damage. This Waiver is only effective for a one-time single continuous stay, of up to 90 days, for which You purchased the Waiver. It takes effect when You occupy the vacation rental property and terminates when You depart the same vacation rental property. This Waiver is only effective if any theft or damage is reported to Waivo by You, the property manager, the online travel agent or the owner of the vacation rental property within 14 days of Your departure from the vacation rental property. Waivo will not respond to damage or theft under $50 US dollars. If there is a dispute related to these terms, mediation is required before any party may file litigation. In the event of litigation, all parties waive the right to a jury trial. IV. DEFINITIONS You, or Your, is the renter of the vacation rental property and includes the renter’s spouse, children and any other person the renter invited on to the vacation rental property during your stay at the vacation rental property. Provided: 3 rolls toilet paper, hand soap, dish soap (small bottle), 1 roll paper towels, 1 trash bag per bin. Outdoor pool area and beach access were damaged by hurricane so until that is fixed guests will be refunded all resort fees. This is a non-smoking unit-we don't care what you smoke, just do it outside. Any smoke smell in home or evidence of smoking in home will result in complete loss of security deposit. If you smoke in the home, it both is unfair to the owner that is working hard to keep their unit nice and to the next guest that rented a smoke-free home. It's Florida, this is non-negotiable so please understand. As a guest of the property manager, you will be part of the Resort VIP Package which offers numerous benefits. During Fall 2022 the outdoor pool area will be being renovated due to damage by Hurricane Ian. Indoor amenities are open, however, all guests will be refunded their resort fees during this time. We have our cleaners thoroughly clean and sanitize the home between each guest. We also ask our guests to please do the following at check-out (note, if this upsets you please simply find another location as there is a massive labor shortage, we frequently have guests ask for early or late check-in/out and this is how we are able to make things smooth for all guests. Please note our check out instructions: 1. Strip all beds used and pillows and put sheets, pillow covers and used towels in a pile in center of room or on beds for beds used. 2. Turn off all lights, fans can be left on. 3. Turn off TVs, coffee makers and other electronics. 4. All dishes should cleaned of old food. 5. Return any books, games, beach items, etc (beach items should be rinsed outside to get rid of any excess sand). 7. Empty any outdoor ashtrays, clean up any cigarette butts. 8. Empty all food from refrigerator (you can leave never opened beverages and used condiments if you wish) put in outside trash and make sure trash is on curb Sun night or Wed night. 9. Make sure keys are left ($50 per key replacement) and garage remote and/or parking pass left on counter ($100 replacement fee). 10. Wipe down countertops and leave home the way you found it. 11. Turn A/C to 78 degrees prior to departure. 12. Drive or fly home safely and come back and see us soon! We work really hard to keep the unit fully stocked with everything you need to enjoy your stay. The point of telling you that is that this is an awesome unit and we work really hard on it, but things can and will happen. We don't know when the microwave will break (if it does we will replace it) or if a Florida palmetto bug will sneak in the house (we are located in Florida which is a jungle..the unit is treated for pests but sometimes they will sneak in and there is nothing we can do about it). Every unit is professionally cleaned prior to check-in but if our cleaners miss something just give us a call and we will send them right back out to fix it. If things like that would bother you, then we may not be the place for you. These are things that we have experienced as well at vacation rentals while travelling and we roll with the punches and have fun. We are not in this business to be a hotel, we have a fun place for guests to stay with friends and family that is fairly priced.. if you are uptight or looking for perfection we aren't the place for you. Parking maxes out at 3 spots, and extra vehicles will need to arrange other parking. Parking is really tight. We are located just north of the Hard Rock Hotel The pool has a soaking tub. It used to be a hot tub but with the sun, sand, salt and wind we had continuous issues with it and therefore, it is not longer included in the rental. When we were growing up, none of us could afford to stay in beautiful beach homes and now to get to have one and share it with you is a dream come true! Over the years we have welcomed lots of guests, many come back year after year to enjoy the beach and home. We have truly enjoyed all the fun visitors that have blessed our home with their memories. Our home is a home-it's not perfect, it's over a hundred years old and it gets used by a lot of guests-so at times things may break and we don't have a crystal ball to know when that will happen. Our property manager reacts extremely promptly to any concerns and will get any issues fixed in a reasonable time. Unfortunately, that does not mean there is 24 hour on call repair service, so if there is an issue you would need to be understanding to the world we are in and know that we will get it resolved as quick as possible. We would ask that if you are uptight, expect perfection or find that your vacation would be ruined if there is an issue that you pass over our home and find another spot. Life is short and we simply don't want to host people that are demanding or just unhappy in life.
